TERMS & CONDITIONS
1) Transmission of Materials: ArdenNet strictly prohibits the use of its Internet service for the transmission of any material that violates federal and/or state laws and regulations. This includes but is not limited to the illegal transmission of: illegally copied software and other copyrighted material, trade secret material, legally offensive and threatening materials.  Since ArdenNet does not monitor the content transmitted through its equipment, the customer agrees to remain solely liable for any and all losses, claims, demands, damages, liabilities, costs and expenses incurred by the customer due to his/her actions while using ArdenNet’s Internet service.

2) Unsolicited E-mail: ArdenNet prohibits the use of its service for the distribution of unsolicited E-mail (sometimes referred to as "SPAM" mail).
The customer agrees to refrain from sending unsolicited e-mail and ArdenNet reserves the right to immediately terminate service without refund upon the customers violation of this agreement.

3) Web Page Content: ArdenNet prohibits the usage of its leased web space for purposes, whether expressed or implied, that violate federal and/or state laws and regulations. ArdenNet reserves the right to use its own discretion in the censorship of material, residing its leased web space, that it finds offensive and/or threatening. We are free to change or remove your homepage off our servers. ArdenNet reserves the right to immediately terminate service without refund upon the customers violation of this agreement.

4) News Service: All postings to USENET must comply with the etiquette guidelines posted in news, announce, new users, and also with the posted charter of the news group(s) to which you are posting.   Non-compliance with these rules will result in the termination of your account without prior notification.

5) Other Networks: Any access to other networks through ArdenNet must comply with the rules appropriate for that other network.

6) Insecurities: The Internet is not a secure system.  The customer is responsible for the protection of his/her own data.  ArdenNet specifically denies any responsibility for the security of your account and the data stored in Arden Computer’s facilities beyond reasonable control.

7) E-mail retrieval: The customer should make every effort to retrieve mail from the (POP3) mail server as often as possible.
ArdenNet is not responsible for lost, misdirected, or undelivered E-mail , including, but not limited to equipment failure (Hardware & Software), delays, negligence on our part, strikes, or acts of God. ArdenNet is not responsible for the content of any incoming E-mail that the customer may receive.   The customer agrees to download e-mail at his/her own risk.

8) Filter: It is recognized that the Internet may contain viruses which may, if not eliminated, destroy parts or all of the data contained within your computer. 
ArdenNet provides some filtering for e-mails which attempts to eliminate some of the common viruses and also some undesirable language. It is advised that the customers provide his/her own additional mechanism for checking his/her computer system for viruses. Further, the customer agrees not to introduce any virus onto the Internet system or ArdenNet’s system. If the customer does so, his/her service will be terminated. The customer agrees to hold ArdenNet harmless from, and to indemnify ArdenNet for, any damages or claims for damages resulting from any viruses or loss of data introduced by the customer into the Internet system or the ArdenNet's computers

 9) Privacy: Although privacy issues are very important to us, given the current regulatory and technical environment you should not have a high expectation of privacy in your account.  By way of example (without limiting the foregoing), we may be forced to disclose private email to the government under certain circumstances and third parties may unlawfully intercept your private e-mail.  Therefore, we cannot ensure that all private email will remain private.

10) Timeouts: All ArdenNet accounts are placed on a "timeout" system except for Dedicated Connection.  Fifteen (15) minute idle-timeout and six (6) hour session-timeout.  If you get disconnected due to this setting, all you need to do is reconnect to continue browsing online.  This has been a standard that most Internet Service Providers follow to prevent abuse.  Our services are Unlimited Access which means you can access the Internet as many time as you want, but not more than (6) hours at a time.


WARRANTY
1) Warranty: Arden Computers or ArdenNet makes no warranties of any kind, whether expressed or implied, for either service provided or Internet technical support given.

2) Limits of Liability: The customer agrees to indemnify, defend and hold Arden Computers, its owners and employees, harmless from and against any and all losses, claims, demands, damages, liabilities, costs and expenses, including but not limited to reasonable attorney's fees and costs of suit arising out of the customer's use of the services provided to him/her by ArdenNet.  This includes loss of data resulting from delays, non-delivery, or service interruptions caused by factors beyond ArdenNet’s control, including, but not limited to equipment failure (Hardware & Software), delays, negligence on our part, strikes, or acts of God.
